As excitement surrounding the launch of online sports betting in Massachusetts continues to mount, consumers, viewers, legal professionals, and fantasy and sports betting companies need to keep their eyes peeled for legal issues that may arise from the cancellation, suspension, or postponement of sports games.
Following the cancellation of the Buffalo Bills-Cincinnati Bengals game on January 2, 2023, fantasy football players are now suing DraftKings for unlawfully canceling their contest entries at fantasy football competitions. According to the ClassAction.org article, a New York City contestant who competed in the $20,000 Two Point Conversion and NFL Showdown 15K Four-Point Stance contests claims he was in first and second place, respectively, when DraftKings submitted the contest entries unlawfully canceled suspension of Bills Bengals game. According to the lawsuit, DraftKings’ terms of service state that if the NFL declares a game “suspended,” statistics generated prior to such suspension count. The lawsuit further states that although the New York participant’s entries were refunded, the participant was also entitled to any winnings earned prior to the game being suspended.
The class action is intended to represent participants who participated in the NFL Showdown and Flash Draft competitions offered by DraftKings and who were declared winners at the time the game was suspended.
