On September 8, 2023, the Government of Vietnam requested that the United States classify Vietnam as a market economy (ME) for purposes of the Anti-Dumping Law (AD) compared to its current non-market economy (NME) status (attached). ME status generally means lower and more manageable/predictable dumping margins (AD) and is therefore preferred for AD purposes. The Western press (e.g. the Financial Times) has recently pointed out that Vietnam has developed into a Central European country. President Biden visited Vietnam to seek closer ties with Vietnam, including trade agreements. We’ll see what happens. But it could be good for Vietnam if it succeeds.
