The second is the ongoing investigation involving classified presidential documents as well as other records, as well as the potential obstruction to the investigation. The investigation is detailed and referenced in court filings submitted as part of a case pending that is pending in the Southern District of Florida.
“Based on recent developments, including the former President’s announcement that he is a candidate for President in the next election, and the sitting President’s stated intention to be a candidate as well, I have concluded that it is in the public interest to appoint a special counsel,” stated Attorney General Garland. “Such an appointment underscores the Department’s dedication to independence and accountability in particularly sensitive matters. The Attorney General further stated, “Although the Special Counsel is not subject to daily supervision by anyone in the Department However, he is required to comply to the rules, procedures and guidelines that are in place at the Department. I will make sure that the special counsel has sufficient resources to carry out the work efficiently and thoroughly. Given the work done up to this point and the expertise of Mr. Smith’s prosecutorial experience I’m confident that his appointment will not hinder the progress of the investigation. The officers and staff who are pursuing these investigations have been conducting themselves with the most rigorous standards of professionalism. I am proud of their work. I strongly believe that the procedures of the Department can handle all investigations with integrity. Additionally, I think that having a Special Counsel at this time is the best decision to make.
