SEC “crypto mom” Hester Peirce calls for regulatory clarity

Peirce calls out SEC

Last year, Peirce expressed her opposition to an SEC crypto custody proposal.

This proposal seeks to expand the scope of custody requirements to include crypto assets, potentially reducing the number of qualified crypto custodians. Peirce believes the proposal is too restrictive and could hinder investors' access to cryptocurrencies.

She criticized the SEC's regulatory approach and accused it of trying to gain control of crypto without appropriate jurisdiction.

The proposal has attracted mixed reactions: some commissioners support it, while others, including Peirce, oppose it. A 60-day public comment period has been established to allow stakeholders to express their views and suggestions.

At the Duke Conference on January 20, 2023, Peirce addressed the fallout from the 2022 bear market, which saw the demise of several leading crypto firms and significant layoffs across the industry. Peirce emphasized the early stages of blockchain technology and argued that innovative technologies need time to develop and mature.

Last October, Peirce also raised concerns about the SEC's enforcement actions against LBRY, a blockchain company.

Peirce disagreed with the SEC's case, citing the lack of evidence of fraud and noting LBRY's cautious approach to digital assets compared to other crypto projects. She criticized the SEC's aggressive stance, particularly the large $44 million penalty sought, and suggested that those resources could have been better used to create a regulatory framework for companies like LBRY.

This, she argued, would have allowed market forces to determine LBRY's fate. The SEC's enforcement actions eventually forced LBRY to close, leading Peirce to question whether the commission's focus on enforcement is hindering innovation in blockchain technology.

Peirce highlighted the uncertainty surrounding the future of cryptocurrency, noting that even respected figures in the field cannot accurately predict its development. She highlighted the critical role of industry developers in driving its development, contrasting them with regulators like herself who lack technical acumen and observation skills from the sidelines.
