Issuers of spot Bitcoin (BTC) exchange-traded funds (ETF) have made significant progress toward regulatory approval.
According to Bloomberg, the US Securities and Exchange Commission (SEC) has given positive feedback on key filings and has not requested further feedback on the filings in several filings.
The agency's commissioners plan to vote on the exchange rules filing this week. At least one applicant, asset manager BlackRock, reportedly expects the SEC to approve its application for a spot Bitcoin ETF on Wednesday, January 10.
Last week, the SEC ordered several exchanges and issuers interested in listing these ETFs to file a final version of a key document by Friday, January 5th.
Multiple reports noted that the SEC has not provided further feedback on filings following recent changes for several companies.
This development signals progress toward regulatory approval in the coming days and paves the way for the launch of spot Bitcoin exchange-traded funds, which has been a target of several companies including BlackRock, Fidelity, Ark Invest, WisdomTree, VanEck, and Valkyrie.
A total of 14 asset managers are currently hoping for SEC approval for spot Bitcoin ETFs. The growing number of applicants and recent improvements in their submissions suggest growing optimism about the approval process.
Analysts also expect Bitcoin ETFs to overcome all potential hurdles, including challenges related to cryptocurrency market activity, further underscoring optimism about approval.
Recognize the hurdles of the Bitcoin (BTC) ETF
Several asset managers have faced challenges in their attempts to launch Bitcoin spot ETFs since 2013. The SEC regularly rejected them on the grounds that the products did not adequately protect investors from risks of fraud and manipulation.
But in 2024, the culmination of recent developments suggests that the approval of a Bitcoin spot ETF is likely to become a reality.
Asset managers have updated their records and provided assurances that their assets will be held in separate accounts with their bank and will not be commingled with the assets of the company or other clients. This has led to expectations that the SEC will interact positively with these companies rather than plan to reject their applications entirely.
Last August, a federal appeals court ruled in favor of Grayscale Investments, which had applied to convert its $16.7 billion Bitcoin Trust (GBTC) into a Bitcoin ETF. The SEC had the opportunity to appeal the ruling but chose not to, signaling a possible change in the regulator's stance on Bitcoin ETFs.
The SEC has historically been cautious about approving Bitcoin ETFs due to concerns about market manipulation and issuers' ability to protect investors. However, recent developments suggest that the regulatory environment may be becoming more favorable for spot Bitcoin ETF approval.
Despite the challenges, the approval of a Bitcoin spot ETF remains an important milestone for the cryptocurrency industry. It would increase Bitcoin's accessibility, liquidity, demand and price, potentially attracting millions of new investors and generating greater interest from larger institutional players.
