Complex arbitrage trading slated for a broader market amid regulatory crackdown
On Wednesday, Flashbots, the leading research team studying Maximum Extractable Value, outlined a protocol that would allow ordinary investors to earn a share of the profits generated by the arbitrage bots, quietly re-enacting blockchain transactions put in order.
Flashbots’ Bert Miller posted a draft design for the proposed protocol, called MEV-share, on the team’s discussion forum. The protocol includes “a permissionless and private matchmaking protocol” that connects users and MEV bot operators (also known as “seekers”).

The proposal comes as US regulators are cracking down on all types of crypto protocols to fit them into the governance regime that has long dominated capital markets. Gary Gensler, chairman of the U.S. Securities and Exchange Commission, has repeatedly said he wants to protect retail investors from the pitfalls of cryptocurrency trading.
In any case, the proposed protocol would allow seekers to compete for transactions via an auction process.

MEV refers to arbitrage techniques used by validators to generate profits by reordering or front-running on-chain transactions. Ethereum users have lost more than $655 million to MEV seekers in the 24 months to last September, according to Flashbots.
Miller said individual wallets and dApps could receive a share of the MEV created by their transactions using the protocol. Searchers can also benefit from the ability to extract MEV from transactions they otherwise would not be able to access.

“MEV-Share was designed to give users power back – they choose exactly what transaction data to hide and disclose through programmable privacy,” Miller said.
Flashbots act as “matchmakers” for transactions executed via MEV-Search. The matchmaker will privately simulate users’ transactions for MEV opportunities. It then submits transactions to block builders on condition that an MEV payment is made to the wallet that executed the transaction.
Speaking on the forum, Hasu, a Flashbots researcher, said Flashbots aim to decentralize the role of the matchmaker over time.

Flashbots was launched in December 2020 to develop software that aims to shed light on and democratize MEV mining.
Flashbots launched its MEV Boost software last year before The Merge last September. MEV Boost allows validators to share in the profits generated by MEV, with players who use the software earning more than double than those who don’t.
More than 90% of Ethereum blocks have been produced by validators currently using MEV-Boost in the last 24 hours, according to MEVWatch.
The U.S. Treasury Department’s sanctioning of Tornado Cash last August sent shockwaves through the crypto sector, with U.S.-based teams forced to block wallets associated with the crypto blending service.
Flashbots shortly afterwards confirmed that MEV-Boost was sanctions compliant and made the code for its relayer openly available, allowing users to develop code that doesn’t block the sanctioned addresses.
Issue
Despite flashbots making the code openly available, the number of blocks produced by sanctions-compliant validators surged to a peak of 79% on November 21, sparking concerns about Ethereum’s validators’ vulnerability to government regulations .
However, the proportion of Ethereum blocks compliant with US sanctions has since fallen sharply, with half of the blocks generated in the last 24 hours accepting transactions from all wallets and 51% in the last seven days.
