ARK Invest, one of the top-class Companies are vying for a spot bitcoin exchange-traded fund (ETF), has amended its SEC filing to add a co-surveillance agreement. The change came a week later BlackRock has submitted for its own spot bitcoin ETF, which included such an arrangement.
As ARK filed its proposal with the SEC in April, nearly two months before BlackRock’s filing. Today’s rework could help ARK cross the finish line first.
As of today submissionThe agreement, dubbed “Spot BTC SSA,” is between ARK, the Chicago Board Options (CBOE) BZX Exchange, and a cryptocurrency platform. However, it has not disclosed which cryptocurrency trading platform it is.
A Surveillance Sharing Agreement (SSA) is the sharing of information with regulators to prevent possible market manipulation. This includes market trading activities, clearing activities and customer identification. The SEC has insisted that none of the applicants have demonstrated their ability to adequately protect investors from manipulative practices.
Previously rejected or pending applications did not include SSAs, which many noticed when BlockRock included one in ETF filing last week. The $9 trillion wealth manager caused a stir and the cops back with his application last week. Whether the industry has a positive attitude because of its size or because of the agreement to share surveillance measures remains speculation.
