Based on the Law on Government Administration, the Hungarian government has ordered an administrative pause for state administrative bodies, including the Hungarian Intellectual Property Office, from December 22, 2022 to January 6, 2023.
The main implications for rights holders are as follows:
- Material processing of applications submitted during the break will begin on January 9, 2023;
- During the break, documents can be submitted electronically, on paper at the IPO machines and by fax;
- The Patent Division extends the periods for performance due during the break by the same number of days as the duration of the break, i.e. 16 days; All applications received during the break will be entered into the IPO system with the date January 9, 2023.
- Deadlines for international trademark registrations and applications at WIPO are not extended; all applications that the IPO will submit to WIPO for which the relevant deadline falls within the pause should be submitted by December 16, 2022;
- Deadlines for trademark searches supplemented with registrability opinions requested during the pause are also extended by the same number of days as the pause lasts, ie 16 days; All applications received during the break will be entered into the IPO system with the date January 9, 2023.
- If the last day of a procedural period falls during the break, the period – including the 30-day period for filing requests for review – ends on January 9, 2023;
- Requests for expert opinions submitted after December 21, 2022 will only be processed on January 9, 2023.
